Terms of service

  • 1. General provisions
    • 1.1. The owner of the hellocashback.me website is SMARTLINE Sagl, c/o TALENTURE SA Riva Albertolli 1 6900 Lugano. These terms are essential for using hellocashback.me and determine the rights and responsibilities of its Users.

    • 1.2. Anyone who registers and participates in the Hello CashbackTM program through the website must be familiar with the terms of use and processing of personal data, and, therefore, accepts them.

    • 1.3. Participation in the Program is free of charge and is open only for individuals (for the purpose of personal use). Legal entities are not allowed to participate in the Program.

    • 1.4. Only individuals who are 18 years and above at the time of registration.

    • 1.5. In case of hotel booking, registered username and the name of person who makes the reservation should be identical.

    • 1.6. The employees (incl. former employees) of the Website owner and SMARTLINE GROUP companies cannot be the Customers (Users) of the Website.

  • 2. Definitions
    • Website - is the website of Hello CashbackTM program, which can be accessed via the following link: hellocashback.me.

    • Platform - means the website on which the Service is available. It is owned, controlled, managed, maintained and/or hosted by SMARTLINE Sagl and is available at hellocashback.me.

    • Customer (Cardholder/User) – a person who is at least 18 years or over and who legally uses the platform. 

    • Partner - legal entity whose services are available to the Customer (Cardholder/User) via the relevant links listed on the Platform.

    • Services - reservation and/or purchase services of the Partners, presented via the relevant links listed on the Platform.

    • Booking - reservation of a room at a hotel, of an airline ticket, rental of a car made by the Customer (Cardholder/User) on the Partner’s website via the link listed on hellocashback.me.

    • Purchase - purchase of goods/services made by the Customer (Cardholder/User) on the Partner’s website via the link listed on hellocashback.me. 

    • Qualified booking/purchase - reservation of the service/purchase made by the Customer (Cardholder/User) through the Partner’s website only via Hello CashbackTM platform hellocashback.me, which meets all requirements defined and described in provision 4 of these Terms of Services.

    • Cashback - returning of a part of the money spent by the Customer (Cardholder/User) for booking services or purchases the Customer. The amount is calculated in accordance with the percentage specified separately for each Partner on the Platform.

    • Virtual Account  - is a Customer’s (Cardholder’s/User’s) account in his Personal Account on the hellocashback.me Platform, which records cashback accruals and shows the current status.

    • Registration - refers to the Customer (Cardholder/User) who performs the following procedure: Filling in the Registration Form on the Website in order to create a Personal Account and receive the Cashback upon acceptance of the Terms of Services and the Privacy Policy.

    • Personal Account – an account created through the Platform located on the official Website hellocashback.me.

  • 3. Main conditions of website usage
    • 3.1. To receive a Cashback the Customer (Cardholder/User) is required to create a personal account through the registration process on the Website.

    • 3.2. Upon completion of the registration process,  an account will automatically be created for the Customer (Cardholder/User) with an internal Virtual Account to which the Cashback will be paid out after the Customer’s (Cardholder’s/User’s) Qualified booking / purchase takes place through the link on the Platform and confirmation by the relevant Transaction Partner.

    • 3.3. Only those who have agreed with the Privacy Policy and the Terms of Services during the Registration process may be registered as Customers (Cardholders/Users) of the website and thus receive Cashbacks.

    • 3.4. The owner of the Website reserves the right not to pay out cashback and also block Personal Account of the Customer (Cardholder/ User) in case of intentional serious violation of these Terms of Services and in case of reasonable suspicion of fraudulent activity.

    • 3.5. These Terms of Services constitute the only existing agreement between the Website owner and the Customer (Cardholder/User). By accepting these Terms of Services, the Customer (Cardholder/User) voluntarily, unconditionally and totally accepts these Terms of Service.

    • 3.6. The Customer’s (Cardholder’s/User’s) consent is given by providing personal data such as first name, last name, PAN, card expiry date, phone number and email address.

    • 3.7. To delete a Personal Account, the Customer (Cardholder/User) must contact Customer Support via the email address specified in provision 5 of these Terms of Service. In case of deleting a Personal Account, a positive balance on the Virtual Account, if it was not used before the removal of the Personal Cabinet, is canceled and can not be returned.

    • 3.8. A Customer (User) cannot create more than one Personal Account on Hello CashbackTM platforms using the same email address for the registration. In case if two or more accounts with the same email are found, the duplicates will de deleted.

  • 4. Terms and conditions of getting a cashback
    • 4.1. The Website’s owner will pay out cashbacks for bookings/purchases made by the Customer (Cardholder/User) to the credit card indicated by the Customer (Cardholder/User) when cashback payout command is activated according to the terms described in provisions 4.1 to 4.11 below.

    • 4.2. Bookings/purchases must be made through the relevant link on hellocashback.me in order to be qualified for a Cashback payout. Such bookings/purchases are defined as Qualified bookings/purchases.

    • 4.3. Reservations made directly through the Partner’s websites do not qualify for a Cashback.

    • 4.4. In order to receive the cashback, the Customer (Cardholder/User) must create a Personal Account through the Website, agree with the Privacy Policy and these Terms of Service.

    • 4.5. In order to receive a Cashback, the Client (User) must enter a phone number that matches the number in the Personal Account, when ordering a service or a product on the Partner’s website. In case of providing another number, the Cashback will not be displayed in the Personal Account and will not be credited to the Client (User).

    • 4.6. The Cashback will not be accrued in case booking/purchase is canceled or of a Customer’s (Cardholder’s/User’s) no-show, even if the Customer (Cardholder/User) is charged by the Partner as per the cancellation policy of the Partner.

    • 4.7. The paid cashback amount  will be displayed in EUR in the Customer’s (Cardholder’s/User’s) Personal Account  within the terms specified in these Terms of Service.

    • 4.8. The amount of the Cashback is calculated on the basis of the value of the booking/purchase and does not include other charges such as taxes, services, room service, restaurant bill, mini bar, spa, etc.

    • 4.9. The amount of the Cashback is non-transferable and cannot be exchanged for money or other products and services.

    • 4.10. Cashback will be accrued immediately after the Partner confirms the fact of a successful purchase / booking, without the additional waiting period from Hello CashbackTM program.

    • 4.11. The minimum amount to payout is 5 EUR. The withdrawal fee is not applied by Hello CashbackTM service, but it can be charged by your bank or payment system.

    • 4.12. In case the owner of the Website has been informed by the Cashback partner of an (alleged) Fraudulent booking / purchase or if the partner has any reasons to believe that the relevant booking / purchase may be somehow related to a fraudulent reservation, the owner of the Website is entitled to not pay out a Cashback for such a booking / purchase. If there is a reason to suspect fraudulent booking / purchase, the owner of the Website is entitled to request from the Customer (Cardholder/User) an email validation that contains the number of booking and a pin code and other needed data at own discretion.

    • 4.13. Website owner takes final decision concerning cashback payout to the Customer (Cardholder/ User).

  • 5. Customer support
    • Customer Support is guaranteed by the Website owner via the email address: [email protected]. Responses to requests will be provided within 72 hours of receipt (excl. national holidays, Saturday and Sunday).

  • 6. Final provisions
    • 6.1. By reserving Partner’s services or purchasing Partner’s goods using the relevant link on the Website, the Customer (Cardholder/User) agrees to these Terms of Services.

    • 6.2. Violation of the rules constituting these Terms of Services will result in refuse to pay out Cashback.

    • 6.3. The owner of the Website is not liable if the cashback is not accrued to the Customer (Cardholder/User) for the reasons dependent on the Customer (Cardholder/User).

    • 6.4. The Owner of the website is not responsible for delayed confirmation of the transaction from the Partner, which may result in a delay in the payout of a cashback to the Customer’s (Cardholder’s/User’s) Virtual account in the Personal account.

    • 6.5. The owner of the Website reserves the right to involve third parties to provide the Customer (Cardholder/User) with the services described in these Terms of Services.

    • 6.6. For the technical implementation of Cashback payouts, in accordance with item 6.5 of these Terms and Conditions, the website owner has engaged e-Residence.com OU as the designated technical service provider.

    • 6.7. The registered Customers (Cardholders/Users) are bound by the Terms and conditions of the Partners whose links are placed on the Platform hellocashback.me and by the Terms of Services provided by Hello CashbackTM program.

    • 6.8. The website contains affiliate links. When a customer clicks on an affiliate link and makes a purchase, the website owner receives a reward from the partner.

    • 6.9. This Terms of Services have been translated into multiple languages. In case of any discrepancies, the English language version shall prevail.
